By accessing or using Firecase ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including developers, organizations, and AI agents accessing the platform programmatically.

2. Description of Service

Firecase provides cloud-based sandbox environments for code execution, including virtual machines, storage, and related infrastructure services. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for:

  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Ensuring your use complies with all applicable laws

4. Acceptable Use

You agree not to use the Service to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Distribute malware, viruses, or harmful code
  • Conduct cryptocurrency mining without authorization
  • Launch attacks against other systems or networks
  • Send spam or unsolicited communications
  • Store or transmit illegal content
  • Attempt to gain unauthorized access to our systems
  • Interfere with other users' use of the Service

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

5. Payment and Billing

Certain features of the Service require payment. By subscribing to a paid plan:

  • You authorize us to charge your payment method on a recurring basis
  • You agree to pay all fees associated with your usage
  • Fees are non-refundable except as required by law
  • We may change pricing with 30 days notice

6. Intellectual Property

Your Content: You retain ownership of all code, data, and content you upload to the Service. You grant us a limited license to host, store, and process your content solely to provide the Service.

Our Service: The Service, including its design, features, and documentation, is owned by Firecase and protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of the Service.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

8. Service Level Agreement

For paid plans, we commit to 99.9% uptime for our core services. Scheduled maintenance windows are excluded from uptime calculations. Service credits may be available for extended outages as described in your plan documentation.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIRECASE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

11. Termination

You may terminate your account at any time through the dashboard. We may terminate or suspend your access immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or us. Upon termination, your right to use the Service ceases immediately.

12. Governing Law

These Terms shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.

13. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes through the Service or via email. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.
